Shining The Light Of Truth On The IRS’ So-Called “Truth About Frivolous Tax Arguments”

Posted on 05 January 2012

Don’t pass up the educational opportunity of a lifetime!  Review what in my opinion is the most comprehensive rebuttal commentary known to exist – entitled “The Real Truth About The IRS’s ‘Truth’ About ‘Frivolous’ Tax Arguments”.  This excellent, one of a kind, commentary explains and rebuts the IRS “The Truth About Frivolous Tax Arguments” report, a report that I believe is filled with half-truths and deceit.  I have been a part of this project for many years and am so excited to finally be able to share its contents with you.  Download it and spread it widely to your fellow Americans so that they can review and discuss these concepts with one another.

    Hi Joe,
I’m an enrolled agent and it has long troubled me about the unfair treatment I’ve seen and heard about by the Service towards clients. We work hard every day to fairly represent our clients, but frequently come up against RAs or ROs who are incredibly unfair and who violate the rules, laws set up to protect taxpayers. I am looking forward to receiving your information.
Thank you for standing up for the truth!

    Hi Joe:
I used to be one of your subscribers several years back. For unknown reasons your emails ceased. Please resubscribe me.

It is amazing to me to hear about Tom Cryer’s death, as he had just emailed me on June 3 promising to send me two of Operation Innoncence Disks, one for me and one for my son Andrew. He did not indicate that he was ill. I am skeptical about his death. Too many of the good men fighting the corrupt government have been suicided.

We are in a 10 year battle with the IRS. AND very familiar with the frivolous return scam. At the momemt, Andrew has been unmercifully levied by SkyWest Airlines, where he drives airplanes for a living.
We would appreciate more input from you regarding frivolous returns.
    Sincerely, Henry Leyva

  16. I have just paid over $60,000.00 in frivolous tax charges – as advised by my attorney. When the first frivolous tax return letter was received I send several letters requesting to know what was frivolous about the returns – in two years of letters and invoicing from the IRS I contacted an attorney in San Antonio (he was recommended to me) who had retired from the IRS advised me to pay the charges – although they were unfounded and told me to apply to get the funds back before a two year deadline. I am interested of how much power can a free country surrender to it’s government before it turns to total socialism – Marxism.

    Dear Sirs,
Thank you for what your doing.I have been harassed by the IRS for the last three years. They have placed leins on my house and back in July 2012 levied my income, stole my money from checking account and closed imy Biz down. They wrote letters to every source of income I had in Branson,Mo. My bank is in the process of foreclossing on my house. The irs agent wants me to come into office in which I missed first appointment and now has set another for Feb. 5 th. She says next step will be to turn me over to Enforcement officer. Would you have any advice on what steps should I make at this point.

    Dear Joe,
I don’t know if you remember me, but I contacted you about testifying at my Federal tax trial in the spring of 2007. You wished me well, but felt you and your family were already targets and testimony would make it worse. I believe it was God’s will for me to loose at trial and spend 53 months in Federal Prison, as I learned a great deal about our Federal Injustice System, but more importantly I gave my life to Jesus Christ. Now I am out and on probation (for 2 more years). I have a 2241 pending in the 6th Circuit Court of Appeals, as I have never given up the fight. I just met with a Revenue Agent and her supervisor in the Nashville office. They will do determinations for 5 more years I didn’t pay taxes. I was told by my probation officer to “not tick them off”, or they’ll go to a prosecutor and try to play the “violation card”. Never a dull moment. Could you send me a link to your original white paper report? I have lost my copy and having trouble finding it. I just watched your interview last year with Alex Jones. Excellent, very well done! Thank you. God bless you, Steve

I have a question regarding the pamphlet referenced above (Shining the Light of Truth on the IRS’ So-Called “Truth About Frivolous Tax Arguments.”

The pamphlet states that the IRS is wrong when it claims that wages are income because income is only profit, while receiving wages for labor is either a “quid pro quo” exchange, or arguing that it is impossible to establish a “basis” in ones’ labor.

On the other hand, it states that only Supreme Court decisions constitute the law of the land that is binding on the IRS. Yet, the Supreme Court has stated many times that wages fall under the “any accession to wealth” definition of the word. (See, US v. Burke, 504 US 229, 233 (1992)). In that case, the petitioner wanted to exclude what the court held to be “back wages” paid in a discrimination settlement from her gross income under section 104(a) of the IRC. So, it seems that the Supreme Court has held that wages are “income.”

Can you have one of the attorney contributors to this pamphlet contact me and explain that to me? I would really appreciate that.

    Thank you very much,
    Alex Wallenwei

  44. Delbert Sinor says:

    Mr. Bannister:
I have been reading your dissertation on the IRS’s “Truth about Frivolous Tax Arguments” and I have a question:

Since the term “income” is a defined ‘term’ in the revenue code (according to Supreme Court Ruling)are we not creating an issue for ourselves by continuing to define revenue that we receive for our labor as ‘income’? It seems to me that we are giving the government, and the courts, ammunition to use against us because, even though we know that revenue paid to us for our labor does not fall under the definition of ‘profits and gains’ (which is the court’s definition of ‘income’)it allows the government and the courts to take the position that income is ‘income’ and therefore subject to the regulations. In other words using the word income to define the revenue we receive for our labor allows the government and legal system to apply the ‘term’ “income” to our argument and claim that it is ‘frivolous’ because it is obvious that anyone who receives ‘income’ has already become a ‘taxpayer’ and, therefore, is obligated to the tax and the code.
It would be my suggestion that we call the revenue we receive what it actually is; ‘reimbursement’ for time, energy, life source, education, expertise and a myriad of other explitives that define what our labor is and that it is solely ours and without subjection to any other person or entity. Reimbursement is not ‘income’ but a simply reinstatement of property that was expended by us and lost to us forever. It is our ‘basis’ and cannot produce ‘income’. Only the revenue that we receive from our labor, when reinvested, can produce ‘income’ as that term has been defined by the courts.

I would appreciate hearing a response from you regarding this.
Thanks for your time and all of your excellent work.
    Delbert Sinor
